Introduction
The Samsung.com Website (the "Website") is operated by Samsung Electronics Singapore Pte. Ltd. ("Samsung"). By using and accessing this Website, you acknowledge and agree to these terms and conditions (“Terms”). In these Terms, references to “you” and “your” are references to the person using or accessing this Website.
Any personal information you provide and/or register on the Website will be stored on an SEC server located in South Korea. All such personal data will be dealt with as set out in the Privacy Policies – which are defined and referred to in more detail in the section below entitled "Data protection".
The information provided on the Website is directed solely at those persons who access the Website from Singapore. Samsung’s business and the services offered by it are governed by Singapore law and no warranties and/or representations of any kind (express or implied) are given as to the compliance of the information shown on the Website and/or our business pursuant to or in respect of the laws of any other country.
Warranties and Disclaimers
Although Samsung and SEC endeavour to ensure that the Website operates smoothly, neither company guarantees, represents nor warrants that your use of the Website will be uninterrupted or error–free. You agree that from time to time, Samsung may remove or otherwise limit access to the Website for periods of time at any time, without notice to you.
You expressly agree that your use of the Website is at your sole risk. The content, products and services delivered to you through the Website are provided "as is" and "as available" for your use. To the maximum extent permitted by law, Samsung disclaim all warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
You expressly understand and agree that to the maximum extent permitted by law, Samsung, their subsidiaries, affiliates, officers, employees, agents, partners and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Samsung has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the Website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the Website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the Website; or (v) any other matter relating to the Website.
Samsung shall use reasonable efforts to protect personal information submitted by you in connection with the Website, but you acknowledge and agree that your submission of any information is at your sole risk, and Samsung hereby disclaim any and all liability to you for any loss or liability relating to such information in any way.
No advice or information, whether oral or written, obtained by you from Samsung or through or from the Website shall create any warranty not expressly stated in these Terms.
Neither Samsung, nor their licensors represent or guarantee that the will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion, and Samsung disclaim any liability relating thereto. You shall be responsible for backing up your own system.
To the extent that any disclaimer or limitation on damages or liability contained in these Terms are prohibited or limited by applicable law, Samsung shall be entitled to the maximum disclaimers and/or limitations on damages and liability available at law or in equity and in no event shall such damages or liability incurred by Samsung exceed SGD10.
Any material downloaded or otherwise obtained through the use of the Website is accessed at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
This section does not include or limit in any way Samsung’s liability: (i) for death or personal injury caused by negligence; (ii) for fraud or fraudulent misrepresentation; or (iii) for any matter which it would be illegal for Samsung to exclude, or attempt to exclude, its liability.
The exclusions of liability set out in these Terms do not affect your statutory rights and only apply to the maximum extent permitted by law.
Anti-crawling / Anti-scraping
When using the Website, you must not use or access our Website in any way that could damage, disable, overburden, impair, or compromise our systems or security, or interfere with other users of our Website. Unless permitted by Samsung, you must not collect, harvest, or use, including without limitation the use of or through the use of crawling, scraping, mining, or any other similar extraction or automated methods, any information or data from our Website, servers, or systems or attempt to decipher any transmissions to or from the servers running our Website.
Data Protection
In addition to these Terms and any Other Terms, the Website is also governed by the Website’s privacy policies (together the "Privacy Policies"), which set out the terms that specifically govern the use of your personal data. The Privacy Policies give you important information about how Samsung and its group companies (including SEC) as well as certain third parties collect, store and use your personal information so please read them carefully before confirming your acceptance to their terms.
Intellectual Property
The Website contains proprietary Samsung information (in the form of text, graphic, audio and video downloads links and downloadable content) which Samsung has invested significant time, money and effort in to develop. All industrial property rights (patents, trademarks, copyrights, design rights, know-how and processes), which are presented, used or made accessible on the Website and/or by means of the Website shall remain with Samsung or with the respective licensor in full. Other than where expressly stated and/or provided pursuant to a license agreement (in relation to Samsung Media Studio, for example), Samsung grants you no license or property right in respect of these rights in relation to your Membership and/or your use of the Services.
Although you may print copies of the information on the Website for your personal use, store the files on your computer and establish links with the Website from your own documents, you may not modify, license, create derivative works from, transfer or sell any content, software or information obtained from the Website.

The inclusion of any such links does not imply that Samsung approves or endorses the contents of those sites and/or the material available there from. Samsung accepts no responsibility for the contents (including the terms and conditions) of any such Websites.

General
These Terms and the use of the Website are governed by (and shall be construed in accordance with) Singapore law. Any disputes relating to the Website which cannot be resolved between Samsung and you will be dealt with exclusively by the Singapore Courts.
Samsung may delay enforcing its rights under these Terms without losing them.
You agree that Samsung may sub-contract the performance of any of its obligations or may assign these Terms or any of its rights or obligations without giving you notice.
If any part of these Terms is determined to be legally invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.
